The IP of BANQ® is exclusively licensed from Public Offering Co, LLC (Henceforward "BANQ® ", "we," "us," and/or "our"). This Site has been created to provide information about our company and its financial matchmaking services (the "Services") to all users of the Site or Service, including entrepreneurs ("Issuers") and Accredited Investors, as defined by SEC Regulation D Rule 501 ("Investors"), who in any way use the Site or Service provided by BANQ® (in each case, a "User"). This Privacy Policy sets forth BANQ® 's policy with respect to information, including personally identifiable data ("Registration Information"), and other information that is collected from Site visitors and users of the Services.

Information We Collect

We may collect Registration Information and other information from you when you voluntarily provide such information to register for access to the Services (for example, contact information such as your name, email address, and mailing address) and when you wish to use certain Services (for example financial information such as bank account numbers, your Date of Birth, and last 4 digits of your social security number) or contact us with inquiries. Access to your Registration Information is strictly restricted to BANQ® employees and contractors, as needed, in order to operate, develop or improve the Services. These individuals are bound by confidentiality obligations. They may be subject to discipline, including termination and prosecution, if they fail to meet these obligations.

By voluntarily providing us with your Registration Information you are consenting to our use of it in accordance with this Privacy Policy. If you provide Registration Information, you acknowledge and agree that such Registration Information may be transferred from your current location to the offices and servers of BANQ® and the authorized third parties referred to herein located in the United States.

Registration Information Privacy

BANQ® does not sell or rent your Registration Information.

BANQ® uses your Registration Information only as follows:

  • To analyze site usage and improve the Service;
  • To deliver to you any administrative notices, alerts and communications relevant to your use of the Service;
  • To fulfill your requests for certain products and services;
  • For market research, project planning, troubleshooting problems, detecting and protecting against error, fraud or other criminal activity;
  • To enforce BANQ® 's User Agreement; and
  • As otherwise set forth in this Privacy Policy.

If BANQ® intends on using any Registration Information in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time at which the Registration Information is collected.

Registration Information and Third Parties

BANQ® may from time to time connect electronically to third parties in order to provide certain features of the Services to you. Your Registration Information or other information is shared with such third parties only if necessary, and only where such third parties abide by this Privacy Policy. Such circumstances include:

Business Transfers: Registration Information and other information you have provided may be transferred to a third party as a result of a sale, acquisition, merger, reorganization or other transfer (a "Transfer") involving BANQ® . BANQ® specifically reserves the right to transfer such information to a third party in connection with a Transfer. Should such a Transfer occur, you will be notified via email and/or a prominent notice on our Site of any change in ownership or uses of your Registration Information, as well as any choices you may have regarding your personal information. We will use reasonable efforts to require that the new combined entity follow this Privacy Policy with respect to your information, as and to the extent required by applicable law and require that you receive notice if your information could be used contrary to this Privacy Policy.

Related Companies: We may also share your Registration Information with our related companies for purposes consistent with this Privacy Policy.

Agents, Consultants and Related Third Parties: When BANQ® employs another company to perform a function of this nature, BANQ® only provides them with the information that they need to perform their specific function. These companies are authorized to use your personal information only as necessary to provide these services to BANQ® .

Legal Requirements: BANQ® may disclose your Registration Information if required to do so by law or in the good faith belief that such action is necessary to:

  • Comply with a legal obligation;
  • Protect and defend the rights or property of BANQ®
  • Act in urgent circumstances to protect the personal safety of users of the Site or the public against fraud or other harm; or
  • Protect against legal liability.

Message Board

If you use the Site's Message Board, you should be aware that any personally identifiable information you submit there can be read, collected, or used by other users of the Site, and can be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit on the Message Board.

Online Session Information

When you visit BANQ® , we may collect technical and navigational information, such as computer browser type, Internet protocol address, pages visited, and average time spent on our Site. This information may be used, for example, to alert you to software compatibility issues, or it may be analyzed to improve our Web design and functionality.

We may use third party service providers to help us analyze certain online activities. For example, these service providers may help us measure the performance of our online campaigns or analyze visitor activity on BANQ® . Your Choices

Portions of your information and data may remain on our backup server or media. BANQ® keeps these backups to ensure our continued ability to prove the Services to you in the event of malfunction or damage to our primary production servers.

Cookies and Web Beacons

"Cookies" are alphanumeric identifiers in the form of text files that are inserted and stored by your Web browser on your computer's hard drive. BANQ® may set and access cookies on your computer to track and store preferential information about you. BANQ® may also gather anonymous information about you through cookie technology on an aggregate level only. For example, BANQ® may assign a cookie to you, to limit the amount of times you see a particular offer or to help better determine which offers to serve you. If you choose to eliminate cookies, the full functionality of the Services may be impaired for you. We encode our cookies so that only we can interpret the information stored in them.

Web beacons are images embedded in a Web page or email for the purpose of measuring and analyzing site usage and activity. BANQ® or third party service providers acting on our behalf may use Web beacons to help us analyze site usage and improve the Services.

This Privacy Policy does not cover the use of cookies by any of our affiliates or service providers. We do not have access or control over these cookies.

Social Media Features

You can log in to our Site using sign-in services such as Facebook or LinkedIn. These services will authenticate your identity and provide you the option to share certain personal information with us such as your name and email address to pre-populate our sign up form. Services like Facebook give you the option to post information about your activities on this Web site to your profile page to share with others within your network.

Our Site also includes Social Media Features such as the Facebook Like button, Twitter, and Add This button. These Features are interactive mini-programs and may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy policy of the company providing it.

Security

The security of your personal information is important to us. When you enter sensitive information (such as bank account information) on our Site, we encrypt the transmission of that information using secure socket layer technology (SSL). We also use third party ID verification to ensure our Users' true identities are validated. When you register for our Services, BANQ® requires a password from you for your privacy and security.

Authentication

Authentication is the process you go through on BANQ® to access secure areas of our Site. This process takes place when you log into your account, the two key components which are Login ID and Password. With regard to passwords, we maintain strict rules to help prevent unauthorized access. You are responsible for maintaining the security of your Login ID and Password. You may not provide these credentials to any third party. If you believe that they have been stolen or been made known to others, you must contact BANQ® immediately to request a change.

We are not responsible if someone else accesses your account through Registration information that has been obtained from you or through a violation by you of this Privacy Policy or BANQ® 's User Agreement.

Children

BANQ® does not knowingly collect Registration Information from children under the age of 13. If you are under the age of 13, please do not submit any Registration Information through the Site. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Registration Information on this Site without their permission. If you have reason to believe that a child under the age of 13 has provided Registration Information to Banq through this Site, please contact us, and we will endeavor to delete that information from our databases.

This Privacy Policy applies only to the Site. This Site may contain links to other Web sites not operated or controlled by BANQ® (the "Third Party Sites"). The policies and procedures we described here do not apply to the Third Party Sites. The links from this Site do not imply that BANQ® endorses or has reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.

Other Terms and Conditions

Your access and use of this Site is subject to the User Agreement.

Changes to Privacy Policy

We may update this Privacy Policy to reflect changes to our information practices. If we make any material changes we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on this Site prior to the change becoming effective. Former Users

If you are a former User of the Site, we treat your information in the same manner that we treat information about our current users.

Exclusions
